Terms of serviceHow we work together. In plain English.
The agreement between your business and us when you use our site, book a call or hire us to set up AI. The short version is first.
In short
Setups and department help are paid up front. A custom connector is paid half at the start and half when it's done. The support plan is month to month after your free first month, and you can stop before any month. What we build in your AI account is yours. AI can make mistakes, so a person on your team checks its work before it counts. Wherever your order with us says something different, your order wins.
These terms
These terms are an agreement between you and Brandtogo LLC, doing business as Figure Hawk ("we", "us"). They cover our website and the services we sell. By using the site, booking a call or buying from us, you agree to them. If you're agreeing for a business, you confirm you're allowed to, and "you" means that business.
Our services are for businesses, not personal use. Each piece of work we agree with you is set out in writing, in a quote or proposal you accept (your "order"). Your order and these terms together are our whole agreement about that work. Where they differ, your order wins.
Using our site
Our guides, templates and examples are general information, not legal, tax, financial or other professional advice. Check anything important with the right professional before you rely on it.
You're welcome to copy and adapt our templates, like the AI usage policy, for your own business. Everything else on the site, including our name, logo, writing and design, belongs to us, and you need our permission to reuse it.
Please don't:
- Try to break into, overload or disrupt the site, or get around anything that limits access to it
- Scrape the site or make automated bookings
- Book calls with false details, or use the site to send spam or anything unlawful
We may block access to the site, or to a demo, for anyone who does.
Demo connectors
Our demo connectors are for trying things out. They run on made-up data, may change or stop working at any time, and come with no promises. Don't send them real customer or business information.
Free calls
Calls booked on the site are free, and taking one doesn't commit you to anything. If you can't make it, reply to the invite and we'll find another time. We may decline or cancel a booking, for example if it looks automated or the details aren't real.
Our services
We set up your AI assistant and help your team use it. That can include:
- Foundations: your AI assistant set up for the owner or the whole team, with training
- Help for a department: a department workshop, a department build or an advanced session
- The support plan: help with updates and questions, every month
- Custom connectors: connections we build when your assistant's own connectors aren't enough
What each one includes is described on our site and set out in your order. Anything outside your order is quoted in writing before we start.
What we need from you
- Your AI plan: one seat for an owner, or a business plan for the team (we help you choose)
- Whoever manages your AI account, for the setup session
- Logins for the apps you want connected, typed by you
- Three jobs each person does every week
Please send what we ask for in good time, and let us know at least one business day ahead if you need to move a session. If something we need arrives late, our dates move with it, and we'll tell you when that happens.
Prices and payment
We share prices on a call and confirm them in your order. How you pay depends on what you buy:
- Foundations and department help: one flat price, paid in full before we start building. An owner setup's price counts toward a team setup bought within 60 days of it.
- Custom connectors: one price, agreed in writing before we build. Half is due when we start and half when it's done.
- The support plan and connector upkeep: billed monthly in advance, after your free first month.
- Extra work: anything beyond your order or your support hours is quoted in writing before we start.
Invoices are due on receipt unless your order says otherwise. If a payment is late, we may pause work until it's paid. Prices don't include sales tax, which we add where it applies.
Your AI plan and your other apps are paid to their makers, not to us, and so are licenses like Copilot Studio or Gemini Enterprise. We don't charge per seat or per request.
Refunds
If you change your mind before we start building, we'll refund what you paid. Once work has started, fees for work already done aren't refundable. If something we built doesn't do what your order says, tell us within 30 days of handing it over and we'll fix it at no charge. If we can't, we'll refund what you paid for that part.
The support plan
Every setup comes with its first month of support free. After that, the support plan is optional and month to month, billed in advance and priced by the size of your team. There's no minimum term and no fee to stop: just tell us before the next month starts. It's required while you have a custom connector, plus monthly upkeep for each connector.
What it covers
- Answers to your questions within one business day
- A 30-minute check-in call each month
- Your skills kept working as your assistant and your apps change
- New and improved skills each month, within the hours for your team size
- People added or removed, with their apps and settings checked
- A 30-minute training session for each new hire, online
- A look at what's new in your assistant every quarter, and what's worth switching on, in that month's check-in
- Your custom connectors kept running: hosting, security updates and fixes when an app changes, with upkeep priced per connector
How far it stretches
- Hours of changes each month are set by your team size, and unused hours don't roll over
- Bigger jobs than your hours allow are quoted in writing before we start
- Weekday business hours, US Eastern time. Not an emergency or round-the-clock service
- Covers what we set up: your assistant, the apps we connected and the skills we built
- Outages at your AI's maker or an app's maker are theirs to fix. We tell you and work around them where we can
- Your team size sets the price. Growing into the next size moves you to its price, and the extra people are set up first
- The free month starts at the setup session and runs 30 days
What it doesn't include
These are quoted separately:
- New custom connectors
- New department builds or workshops
- Setting up a new team
- Moving you to a different AI assistant
Custom connectors
We build a custom connector to do the jobs set out in your order. It runs on a private server we host and maintain for your business alone.
- One app or system per connector, doing the jobs agreed in writing
- Needs the support plan while it runs, plus monthly upkeep for each connector
- New jobs after it is built are quoted in writing first. Fixes when an app changes are part of upkeep
- Some apps wait on their maker's approval, so those are on request
- In Copilot and Gemini it needs Copilot Studio or Gemini Enterprise, which you license from Microsoft or Google
If the support plan ends, we turn the connector off and delete its data within 30 days. If you want a copy of anything it holds first, ask us before then.
Your accounts and data
Your data stays yours. You let us access your accounts and data only to do the work in your order, and we handle it as our privacy policy explains.
You're responsible for:
- Your AI plan and app accounts, including their terms, settings and who on your team has access
- Having the right to let us work with the information in your accounts, including your customers' details
- How your team uses AI, and what it sends, approves or changes
Confidentiality
We each keep the other's non-public business information confidential and use it only for our work together, during it and after. That doesn't cover information that's already public, that one of us already had, or that the law requires us to share.
AI and other companies' services
AI assistants can be wrong, and sound sure when they are. We set yours up so sending, changing and paying ask a person first, and we train your team to check its work. What your business sends, approves or changes is still up to your team, and you're responsible for it. Don't rely on AI alone for legal, tax, financial, medical or HR decisions.
Your AI assistant and your apps are made by other companies, under their own terms. They change features, prices, limits and rules, and sometimes go down. We'll help you adjust under the support plan, but we aren't responsible for their services, their outages or how they handle your data.
Who owns what
What we make for you in your accounts is yours: your company profile, skills, shortcuts, rules, cheat sheets and training recordings. Keep using and changing them whether or not you stay with us.
We keep ownership of our own tools, templates, methods and connector code, which we reuse for other clients, never with your data. While we run a custom connector for you, you may use it for your business.
Our promises, and their limits
We'll do our work carefully and professionally. If something we built doesn't do what your order says, we'll put it right, as set out under Refunds.
Apart from that, the site and our services come "as is". We can't promise particular results, like hours saved or sales won, because they depend on your team, your apps and your AI's maker.
As far as the law allows:
- Neither of us is responsible to the other for indirect or consequential losses, like lost profits, lost data or harm to reputation
- Our total responsibility for all claims connected to our services is limited to what you paid us in the 12 months before the claim arose
These limits don't apply where the law doesn't allow them to, like in cases of fraud.
If someone makes a claim against us because you broke these terms, or because you gave us information you had no right to share, you'll cover our reasonable costs of dealing with it.
Ending our work together
You can stop the support plan before any month, as above. Either of us can end our work together by email if the other seriously breaks these terms and doesn't fix it within 14 days of being told. When our work ends:
- You pay for work done and services used up to that point
- What we made in your accounts stays yours
- We remove our access to your accounts and turn off any custom connectors
Parts of these terms that are meant to last, like confidentiality, ownership, payments owed and the limits on responsibility, keep applying.
Disputes
If something goes wrong, email us first. Most problems get sorted out by talking, and we'll both try in good faith for 30 days before taking it further.
These terms are governed by the laws of the State of Massachusetts. Any dispute goes to the state or federal courts in Massachusetts, and we both agree to those courts.
The fine print
- We're an independent business, not your employee or agent.
- Neither of us is responsible for delays caused by things outside our control, like an outage at an AI maker. This doesn't excuse payments that are due.
- You can't transfer these terms to someone else without our OK. We may transfer them if our business is merged or sold.
- If part of these terms can't be enforced, the rest still applies. If we don't enforce something straight away, we can still do it later.
- We send notices by email to the address you gave us. Send yours to support@figurehawk.com.
Changes to these terms
We may update these terms, and the new version applies from the date at the top. For current clients, changes apply from the next support month, and we'll email you about any change that matters before it takes effect. A change never alters an order you've already accepted.
